(TheRedWire.com) – Air National Guardsman Jack Teixeira, accused of having leaked several classified documents online, has requested from a federal judge that he be treated in the same way as former President Donald Trump, including being allowed to be released until his trial.

On Monday, Teixeira’s lawyers filed a motion claiming that the government has attempted to keep him detained, an effort undermined by the fact that both Trump’s aide Walt Nauta and former President Donald Trump himself have been released prior to their impending trial.

All three of these cases relate to mishandling classified documents and information and include additional charges such as conspiring to obstruct justice. In the filing, they also point out that Trump had been given access to some of the nation’s most sensitive documents and national defense information that the government had gathered. Yet, he had been allowed to be free despite the possible flight risk. Trump owns multiple properties outside the country and has access to a private jet.

The filing notes that the government has taken two completely different approaches in these two cases, demonstrating that the pretrial detention of Teixeira because of the knowledge he had access to is “illusory.”

In May, U.S. Magistrate Judge David Hennessy had ruled against Teixeira’s release arguing that there was a high chance he would attempt to leave the country or try to obstruct justice.

Teixeira has pleaded not guilty to all six counts, including violations of the Espionage Act.
