
(TheRedWire.com) – U.S. District Judge Mark Scarsi accused Hunter Biden’s legal team of making “false statements” in their motion to have his federal tax indictment charges dismissed.
The federal judge has threatened to impose sanctions on Biden’s attorneys after they falsely claimed in the motion that U.S. Attorney David Weiss had only proceeded with bringing forward charges after he was appointed as special counsel. However, as he pointed out these allegations are untrue which is something that Biden’s counsel is aware of.
In the three-page order, Scarsi has requested Biden’s attorneys to exhibit why he should not pose sanctions for the false statements that had been made in the motion. The judge allowed for a one-week time frame during which the attorneys can provide an explanation and reasoning not to face sanctions, including possible monetary fines and professional disciplinary proceedings.
Scarsi noted, in his order, that Weiss had brought forward charges against Biden before becoming special counsel, as he had originally filed two misdemeanor charges in June 2023 against Biden during his time as the U.S. attorney in Delaware.
Weiss was appointed as special counsel after a plea agreement with Biden had fallen apart. In his recent California nine-count tax indictment, two of those original misdemeanor counts are also included.
Scarsi argued that this is not a trivial misstatement and that he does not have “tolerance for lack of candor.”
Biden’s attorneys have been pushing to have the tax indictment completely dismissed after they argued that Weiss was appointed unconstitutionally and that the investigation had been unlawfully funded.
