Jack Smith Barks Orders At Judge Cannon

(TheRedWire.com) –  On Friday, Special Counsel Jack Smith urged Judge Aileen Cannon in a filing to not apply the recent Supreme Court ruling to the classified documents case against former President Donald Trump. 

In the filing, Smith had agreed to a briefing regarding the ruling, which gives presidential immunity from prosecution to the core presidential powers. The ruling relates to official acts as per the opinion which was written by Supreme Court Justice Clarence Thomas. 

Smith, however, in his filing argued that Cannon did not consider Thomas’ concurring opinion relating to the ruling, which is something that Trump and his team have been pushing for her to do. 

Trump’s team had previously filed a motion to pause the classified documents case only days after the Supreme Court had handed down its decision in the presidential immunity case. Focusing on Thomas’s opinion the Trump team had questioned whether Smith’s appointment to these cases had been lawful. 

Thomas pointed out that if this unprecedented prosecution were to continue then it should be conducted by someone who has the authorization by the American people to do so. He argued that therefore the lower courts would need to first address the essential questions relating to Smith’s appointment before moving forward. 

A day after the opinion was released, Cannon had approved the request by the Trump team to delay certain deadlines so that the new Supreme Court ruling could be evaluated in this case. 

However, Smith in his filing pointed out that the arguments Thomas had made against him were not relevant to the current case that was before the court.
