(TheRedWire.com) – Republican presidential candidate Nikki Haley has called on New York Gov. Kathy Hochul to pardon Daniel Penny, a Marine veteran who put Jordan Neely in a fatal chokehold while on the New York City subway.

The incident which was caught on video took place this month, when Neely, a homeless subway busker who often performed Michael Jackson dance routines at the subway was pronounced dead after Penny put him in a chokehold for close to 15 minutes. The chokehold came after a verbal dispute which led to two other subway riders who along with Penny appear to be trying to restrain Neely.

Haley, who appeared on Fox News on Tuesday night for an interview, pushed Hochul to pardon Penny, arguing that it would be the right thing to do for him to be pardoned immediately. She proceeded to argue that Penny, who has served in the military, is focused on defending and protecting both himself and others.

In the incident at the New York subway, Penny had found himself in perceived danger which was why he attempted to protect himself and everyone else who was on the subway. She proceeded to slam how District Attorney Bragg would indict him without an investigation or grand jury being involved. Haley also alleged that Bragg, who is often targeted for being soft on crime, was allowing street crime all over the city. She added that if this continues criminals would be allowed to continue to have control of the city.
