One Crash That Changed a State Law Overnight

The crash that triggered all of this was not abstract. A 30-year-old driver from Kazakhstan entered the United States using the CBP One federal parole program, obtained a commercial driver’s license in Pennsylvania, and then drove a semi-truck into oncoming traffic in Indiana, killing four men. Immigration and Customs Enforcement arrested him at the scene. Pennsylvania Governor Josh Shapiro argued the driver had legal status when he obtained the license. That may be technically true, and it is also entirely beside the point for the four families who lost someone. [4]

Indiana did not wait for a federal study. The state banned commercial driver’s licenses for illegal immigrants effective at midnight on the day the law passed, requiring all applicants to prove proper visa status before receiving a commercial license. Indiana’s Bureau of Motor Vehicles said roughly 3,000 non-domiciled commercial license holders existed in the state prior to the law, representing less than two percent of all commercial drivers. Over 1,000 licenses were revoked. Critics called the law overbroad, arguing it swept up refugees and legal immigrants. That criticism deserves a fair hearing, but the underlying compliance problem it was responding to is real. [2]

The Federal Crackdown Revealed a System Running on the Honor System

Operation Midway Blitz, a joint enforcement action involving the Indiana State Police and federal agents, produced 223 arrests of undocumented immigrants operating commercial vehicles. Department of Homeland Security and Transportation Secretary Sean Duffy reported that 46 of those individuals were driving tractor-trailers and 82 were operating large box trucks and vans. These are not passenger cars. These are vehicles weighing up to 80,000 pounds sharing highways with families in minivans. [1]

Duffy also announced in February that all commercial driver’s license knowledge and skills tests must be administered in English going forward. Opponents pushed back, with one truck safety advocate arguing that English fluency and driving competency are separate things. That is a reasonable distinction in a classroom. On an interstate at 65 miles per hour, a driver who cannot read a hazmat placard or understand a weigh station officer’s instructions is a different kind of problem. [1]

The CDL Mill Problem Nobody Was Fixing

The enforcement numbers that got the least attention are the most alarming. The federal government removed or flagged over 7,000 commercial driver’s license training providers nationwide for noncompliance with federal safety standards. Separately, nearly 2,000 unqualified drivers were pulled from the road, including approximately 500 who lacked the English proficiency required under existing federal regulations. Some training providers were flagged for certifying attendance without conducting actual training. These are not immigration problems. These are systemic failures in a credentialing system that governs who operates the most dangerous vehicles on American roads. [2] [1]

The honest accounting here is that the immigration framing, while politically potent, obscures a broader breakdown. Sanctuary state rhetoric and border-policy blame games make for compelling television, but the Federal Motor Carrier Safety Administration’s own compliance failures predate the current border debate by years. What the Indiana crackdown did was force a reckoning that federal regulators had been slow-walking. When a victim’s family member named Marcus Coleman asked on national television, “Who’s protecting us?”, he was not asking a partisan question. He was asking the right one.
