(TheRedWire.com) – Former Vice President Mike Pence on Wednesday promised that he would fight the subpoena that would require him to testify before a grand jury in the Department of Justice’s investigations into Trump’s attempts to overturn the 2020 election.

Pence said that he would try to fight the subpoena which he considered to be “unconstitutional” and “unprecedented.” He added that if needed he was willing to take his case to the Supreme Court.

Following an event in Iowa Pence told reporters that he knew former President Trump was going to make claims of “executive privilege.” However, he noted that this would be Trump’s fight. He added that his fight was to make sure that the separation of powers set out in the United States Constitution was respected.

A source close to Pence also confirmed with the Hill that Pence was planning on fighting the subpoena sent by special counsel Jack Smith, who is in charge of the investigation on Trump’s role in trying to overturn the election and the Jan. 6, 2021, Capitol Attack. Smith is also overseeing the investigation into the classified documents found in Trump’s Mar-a-Lago estate.

Pence and his team are claiming that since on Jan. 6, 2021, he was serving as the then-president of the Senate, he would be protected under the “speech and debate” clause of the Constitution which protects members of the legislative brand.

The former vice president also reiterated that Trump’s attempts to pressure him into not certifying the 2020 election results were “wrong.”
