(TheRedWire.com) – Senate Democrats have been pushing for conservative Justice Clarence Thomas to recuse himself from participating in the ruling on whether or not former President Donald Trump has immunity from being prosecuted for alleged crimes he had committed during his time in the White House.
Senate Judiciary Committee Chairman Dick Durbin (D-Ill.), along with other panel members, have argued that there is a conflict of interest for Thomas, as his wife Ginni, had previously been an outspoken supporter of the false fraud allegations regarding the 2020 presidential election.
Durbin pointed out that there were still many questions that needed to be answered relating to the relationship between Justice Thomas, his family, and the Trump administration. Hence it would be in Thomas’ best interest if he would “recuse himself” from the case. He further stated that he was concerned about the possibility that the Supreme Court, which has a conservative majority with three justices having been appointed by Trump, could ultimately rule that Trump has immunity.
If Trump is granted immunity then he can no longer be prosecuted by Fulton County District Attorney Fani Willis (D) or special counsel Jack Smith over the decisions that he had taken during his time in office to block the transfer of power in 2021. Durbin added that it was diminishing the country’s values to claim that there were certain people who were “above the law.”
Durbin’s comments came after Smith filed a petition with the Supreme Court to consider whether or not Trump had immunity in these cases.
